Road Traffic Accident: Uninsured or untraced drivers - What can I do?

In the UK, the Motor Insurance Bureau (MIB) provides a route of compensation for such road traffic accidents where the Defendant driver is uninsured or untraceable.

Who can claim?

The scheme covers accidents that occur where:

  • The driver at fault is uninsured or untraced (e.g. lack of insurance or registration details).
  • The accident occurs on UK roads.
  • The vehicle involved was in use at the time of the accident.
  • The victim is either injured and/or their property is damaged.
  • The victim must have been a driver, passenger, pedestrian, or cyclist involved in the accident.

A claim can be made through the MIB so long as there are no other insurances identified.

What should I do following an accident?

It is important to obtain as much information about the accident as possible.

For instance:

  • Write down any details you can recall of the other party, their physical appearance and their vehicle details.
  • Take down details of the location of the accident.
  • Take photographs of any damage and of the scene of the accident.
  • If there are any witnesses to or following the accident - ask for their contact details.
  • Report the incident to the police as soon as is possible.
  • Contact your insurers about the accident.

How Does the Scheme Work?

Submit a claim to the MIB: After reporting to the police, the next step is to make a claim through the MIB. Claims must be submitted within 3 years of the accident. Any submission should include supporting evidence, i.e. witness statement. The MIB will then investigate the claim.

Consideration of claim: The MIB will assess the claim to determine eligibility for compensation. If the driver cannot be traced or identified, and the MIB concludes that the claim is valid, they will handle the compensation process.

Compensation Payments: If accepted, the compensation can cover:

  • Medical expenses
  • Lost earnings due to injury
  • Property damage
  • Pain and suffering caused by the accident
